SC restores Narcotics Body’s powers

New Delhi – Feb.11 – The Supreme Court of India on Tuesday empowered the Narcotics Control Bureau (NCB) personnel to search and arrest persons possessing narcotics, reversing a Delhi High Court ruling that had taken away their powers to carry on the task.  Holding that the NCB is a part of the Finance Ministry, the apex court said the Narcotic, Drugs and Psychotropic Substances Act authorizes the Centre to entrust officials with powers to search persons and seize drugs from their possession to arrest them.  The court’s findings came on two appeals filed by the NCB against Delhi High Court’s judgement and an accused against the Karnataka High Court’s ruling.
